Shipping and Return Policy

SHIPPING

Retail orders are shipped via USPS within 5 business days after payment is received. Wholesale or custom orders will take longer to create and process. See Wholesale Terms for more information about lead times, or please contact me for specific information regarding your order or about a custom order.

RETURNS

I take great care to photograph and accurately describe each jewelry piece to the best of my ability. I hope you'll love your new jewelry but if you are not satisfied with your purchase, I'll try to make it right. Refunds or exchanges are accepted within 5 days of delivery, minus the cost of shipping. IMPORTANT: Please contact me to arrange for your return PRIOR to shipping any package back. Pieces returned without prior email approval, and/or outside of the 5-day return policy may be refused and return shipping will be your responsibility.

Your return will be processed as soon as I receive it. All returns must be prepaid, insured, and shipped via a major carrier. Original shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. To be eligible for a return, your item must be in its original packaging, with no signs of wear or damage, and in the same condition that you received it. I do not accept returns in which the item has been worn, damaged, or has missing parts.

Once you receive an approval email. please pack the item(s) in their original packaging with enough packing material (padding) to protect the piece(s) during shipping. You are responsible for poorly repackaged items or damages incurred during shipping, and I have the right to deny credit if the piece(s) returned do not meet my return policy criteria. I am not responsible for tracking your return and am unable to issue a refund for packages that are lost, stolen, and/or damaged in transit. In those cases, it will be your responsibility to contact the shipping carrier.

REFUNDS

Once your return is received and inspected, I will send you an email to notify you that I have received your returned item. If your return is approved, then your refund will be processed, and a credit (minus the cost of shipping) will automatically be applied to your original method of payment. The credit should be back to your account in approximately 3-5 business days. (NOTE: Transaction time varies from bank to bank so I cannot guarantee return deposit times.)

LATE OR MISSING REFUNDS (if applicable)

If you haven’t received a refund, first contact your credit card company, noting that it may take some time before your refund is officially posted. Next, contact your bank as there is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact me.

RETURNING A GIFT

If the item was sent as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, I will send a refund to the gift giver and he/she will be contacted about your return. You are responsible for return shipping charges.

REPAIRS

Due to the nature of handcrafted jewelry, my pieces are made for delicate use. However, I stand behind my work. If a part of a jewelry piece breaks or no longer functions (clasps, chains, etc.) during normal wear, I will fix it free of charge (not including shipping fees). This does not cover damage incurred from being dropped, immersed in water, or otherwise mishandled. (Please see my advice on proper jewelry care.) I am not responsible for damage that occurs during shipping. If the jewelry is damaged in transit, please contact the shipping company.

I understand that things happen though! If you accidently damage a piece (drop it, break a chain or pendant, etc.), all is not lost! I may be able to repair it for a small fee. Please be aware that not all damage can be repaired (e.g., breaking a chandelier crystal pendant, etc.). Please contact me for details.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.sparklingvinedesign.com (the “Site”).

PERSONAL INFORMATION I COLLECT

When you visit the Site, I automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, I collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. I refer to this automatically-collected information as “Device Information.”

I collect Device Information using the following technologies:

1) “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org. The following cookies are used on this site:

2) “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

3) “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

PAYMENT

When you make a purchase or attempt to make a purchase through the Site, I collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. I refer to this information as “Order Information.”

My site is hosted on Wix.com. When you choose a direct payment gateway to complete your purchase, Wix.com stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by my store and its service providers. When I talk about “Personal Information” in this Privacy Policy, I am talking both about Device Information and Order Information.

HOW DO I USE YOUR PERSONAL INFORMATION?

I use the Order Information that I collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, I use this Order Information to: communicate with you; screen my orders for potential risk or fraud; and when in line with the preferences you have shared with me, provide you with information or advertising relating to my products or services.

I use the Device Information that I collect to help me screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize my Site (for example, by generating analytics about how my customers browse and interact with the Site, and to assess the success of my marketing, advertising, and retargeting campaigns).

SHARING YOUR PERSONAL INFORMATION

I share your Personal Information with third parties to help me use your Personal Information, as described above. For example, I use Wix to power my online store. They provide me with the online e-commerce platform that allows me to sell my products and services to you. Your data is stored through Wix.com’s data storage, databases and the general Wix.com application. They store your data on a secure server behind a firewall.

Finally, I may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information I receive, or to otherwise protect my rights.

BEHAVIORAL ADVERTISING

As described above, I use your Personal Information to provide you with targeted advertisements or marketing communications about my brand that I believe may be of interest to you. PLEASE NOTE: I do not sell or share your Personal Information to anyone for any other marketing purposes. THIRD-PARTY SERVICES

In general, the third-party providers used by me will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to me. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information I am required to provide to them for your purchase-related transactions. I use Square and PayPal for my site's payment gateways, and I recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or I. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave my store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or my website’s Terms of Service.

I have installed third-party Apps on my website through Wix.com in order to add and improve site functionality. These Apps and their respective providers share and/or access certain Non-personal and Personal Information via the “WixHive” API. Such information includes, among others, contact details, messages, business applications and certain activities on the Services and/or User Website, which are stored and thereafter accessible via your User Account. Your Personal Information is transferred to and processed by Wix.com on my behalf. In order to further protect your privacy, Wix.com contractually prohibits all third-party developers from combining Personal Information collected across different User Websites and Services, and from sharing Users-of-Users’ Personal Information other than with other Apps installed on the same User Website or Services, for the purposes of such specific User Website or Services. Wix however may still access and use information collected and stored via the WixHive API across different User Websites and Apps, as necessary for providing and improving its Services.

Please note that I do not alter my Site’s data collection and use practices when I see a Do Not Track signal from your browser.

LINKS

When you click on links on my store or blog, they may direct you away from my site. I am not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECURITY

To protect your personal information, I take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed. When you provide me with your credit card information, the information is encrypted using secure socket layer technology (SSL) and secured by HTTPS/TLS (Transport Layer Security) encryption. TLS is the standard security technology for establishing an encrypted link between a web server and a browser. This link ensures that all data passed between the web server and browsers remain private and secure. TLS is the industry standard and is used by millions of websites in the protection of their online transactions with their customers. Although no method of transmission over the Internet or electronic storage is 100% secure, I follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Wix.com is certified under the EU-US Privacy Shield Framework and the Swiss-US privacy shield framework as set forth by the U.S. Department of Commerce, regarding the collection, use, and retention of personal information transferred from the European Union to the United States, and therefore adheres to the Privacy Shield Principles.

YOUR RIGHTS

If you are a European resident, you have the right to access personal information I hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact me through the contact information below.

Additionally, if you are a European resident I note that I am processing your information in order to fulfill contracts I might have with you (for example if you make an order through the Site), or otherwise to pursue my legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, I will maintain your Order Information for my records unless and until you ask me to delete this information.

CHANGES

I may update this privacy policy from time to time in order to reflect, for example, changes to my practices or for other operational, legal, or regulatory reasons.

CONSENT

When you provide me with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, return a purchase, or opt-in to my mailing list, you imply that you consent to my collecting it and using it for that reason.
